Privacy Policy Declaration for the SuccessFactors Applicant Portal of lasselsbergergroup

Thank you for your interest in our company and our job offers. In order to process your application, it is necessary to provide your data. This privacy policy applies in relation to the SuccessFactors applicant portal and the personal data processed therein. The protection of your personal data is very important to us. Therefore, in accordance with Art 13 DSGVO, we inform you below about the collection, processing and use of your data within the scope of the applicant portal.

Controller for data processing

The "lasselsbergergroup" refers to several affiliated companies or subsidiaries (visible on our homepage under Divisions, Lasselsberger Group), each of which represents an independent legal entity and is responsible as an independent controller for the purposes and means of data processing. The data collected through this applicant portal is made available to the respective company that has advertised a position. At your request, this data may also be shared with the other affiliated companies.

The company that provides the applicant portal to the affiliated companies and thus acts as the main controller for the processing and storage of your personal data is LASSELSBERGER Group GmbH (Imprint). If the application is made to one of the affiliated companies of LASSELSBERGER Group GmbH, LASSELSBERGER Group GmbH will process your personal data on behalf of this affiliated company and will act as a processor. 

Type of data collected

In the course of your registration on our applicant portal, we will collect and process the following personal application data from you:

  • Name, first name
  • Your address
  • Your phone number
  • e-mail address
  • Photograph
  • Residence
  • Application documents (letter of application, curriculum vitae, references, certificates, etc.)

Special categories of personal data (sensitive data)

According to Art 9 GDPR, special categories of personal data are those revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as genetic data and biometric data uniquely identifying a natural person, health data or data concerning a natural person's sex life or sexual orientation. 

No such sensitive data will be collected during the application process and applicants are requested not to provide any such sensitive data in the application. Should sensitive data have been disclosed by applicants, this was voluntary, and the processing of such data is based on voluntary consent pursuant to Art 9 para 2 lit a in conjunction with Art 6 para 1 lit a DSGVO.

Purpose and processing

The personal data you provide as part of the application process, as well as your documents, will be collected, processed and used by us exclusively for the purpose of processing your application and in the job filling process.

Your application data will not be used for any other purpose or passed on to third parties. Your application data will only be processed by the HR department, the department heads of the departments concerned and the managing directors. This refers to both LASSELSBERGER Group GmbH and any affiliated company.

Lawfulness of processing

The processing of your personal data is based on the following legal grounds:

In order to be able to assess whether you are suitable and qualified for the position for which you have applied and meet the necessary requirements for initiating a contract under employment law legal ground based on Art 6 para 1 lit b DSGVO.

To protect the legitimate interests of the controller unless the interests or fundamental rights and freedoms of the data subject prevail legal ground based on Art 6 para 1 lit f DSGVO. The legitimate interest for the processing is to implement and ensure a smooth application process.

The applicant's personal data will be treated confidentially in accordance with Section 6 para 1 of the Austrian Data Protection Act, without prejudice to any other legally regulated obligations of confidentiality, unless there are legal grounds requiring us to disclose the data.

At your request, it is possible to share the application data within "lasselsbergergroup" with other affiliated companies in order to check the availability of further or other vacancies. However, this will only be done with your express consent within the meaning of Art 6 para 1 lit a DSGVO when you register in our applicant portal.

When you register, you have the following options to choose who can see your data within "lasselsbergergroup":

  • All recruiters of the company worldwide
  • All recruiters of the company in my country/region
  • Only recruiters who are in charge of jobs I am applying for

Data storage and retention periods

We work according to the principle that your personal data will only be kept for as long as is necessary for the aforementioned purpose of processing the application. 

If your application was successful, the data you provided may be further used for the employment relationship and will be transferred to the personnel file. In the event of an unsuccessful application, we are required to retain your applicant data for a longer period of time in order to fulfill our professional and legal requirements, to establish, exercise or defend our legal rights, and for archiving purposes. This retention period is generally six months and is re-triggered based on the last activity date. For example, an activity in your Applicant Customer Portal account is your login to the Platform or any changes or updates to your account. Thus, each time you log in to your applicant portal account again, you express your active interest in our company and agree that we may keep a record of your data in our database for another six months. You will also be informed of this in the welcome text each time you log in. If no activity is detected in your account within these six months, your data will be deleted or anonymized by us. Further processing or access to your personal data is no longer possible after this time.

Right of access by the data subject

Upon request, LASSELSBERGER Group GmbH will provide you with written information about the personal data stored about you as part of the application process. This information includes the purpose and category of the personal data, recipients and recipient category, any recipients in a third country and the duration of the data storage. You have the right to request copies of the stored data.

Right of rectification

If data is incorrect or incomplete, you have the right to have this data corrected or completed.

Right to erasure

You have the right to request the deletion of your personal data stored by us. You also have the right to object to the processing of your data at any time and to withdraw your application with immediate effect for the future.  This is possible online via your applicant account or by sending us an e-mail to jobs@lasselsberger.com. Such revocations do not affect the previous lawfulness of the processing of your data.

This right of deletion or objection does not exist if the processing is still necessary for legal reasons or for the assertion, exercise or defense of claims.

Right to data portability

You have the right to data portability and the right to provide us with the identity of a third party to whom we should transfer your data in a structured, common and machine-readable format. 

Right to lodge a complaint with a supervisory authority

You have the right to lodge a complaint with the national data protection authority in your country of residence at any time about alleged violations of the principles of processing your data or of your rights.

Data security

"lasselsbergergroup" uses technical, physical and organizational security measures to ensure the integrity, confidentiality and availability of the data you provide and to protect it from manipulation, loss, destruction or unauthorized access. Applicants themselves play an important role in the security of applicant data. You should therefore keep your password confidential at all times and follow the correct procedure for logging in and out of our applicant portal. Our security measures are continuously revised, adapted and improved in line with technological developments.

The applicant data and access to it may be transferred to various countries in which "lasselsbergergroup" operates, if necessary for the application. This may also include transfer to third countries outside the European Union (e.g. Australia, China). Such a transfer will only take place in the case of an application in the respective country or if the applicant consents to the sharing of data within "lasselsbergergroup". If such an international data transfer takes place to a country with a different data protection system, it is ensured that the data transfer does not negatively affect the level of protection of your personal data.

“lasselsbergergroup" will ensure appropriate security measures and valid transmission mechanisms for the transfer and processing of applicant data.

The constant development of the Internet makes it necessary to adapt our data protection principles from time to time. We therefore reserve the right to make appropriate changes at any time. Any changes will in no way restrict your rights.
